Bypass switching problem

G'day guys, just a quick question. I was going through some effects that had problems and came across a tone bender I made, however the bypass switching was wired up like RG's bypass except with a PNP transistor (collector to -9V, base to switch and emitter to the 1K resistor). The transistor is a PN200 (much like a 2N3906 and a 100 other's)

First question, why doesn't it work? I know RG's uses a FET and suspect that's got  something to do with it, but just wondering could this arrangement work somehow?

Or is it just easier to use Jack Ormans positive ground true bypass with a 2N3904??

Any other suggestions for a positive ground effect?
