Tonebender MKII 3 germaium pedal needs help!

hey there, this is my first pedal fom scratch.  got from

www.tonepad.com/projects.asp?projectType=fx

just put together this pedal WITHOUT SUGGESTED AC JACK (using battery instead)
hooked her up and fuzz works, as do both pots ......BUT pedal sound cuts out as notes grow quieter.  only lasting bout a second before u strike the strings again...
when i turn guitar vol pot down a little, pedal seems to recieve NO signal...
i am using 3pdt switch but have not hooked up led.

too much resistance somewhere???
circuit prob or wiring prob??
or neither?

PS, i ordered transistor set from small bear elec and on the schematic THEY sent of the board, he had crossed out R3 resistor value and changed it from 47k to 24k....... I put 27k in its place....
