so whenever i rock my wah forward in the wah mode it gets more trebley as expected but almost all volume drops out. transistor going bad or waht (hehe no pun intended)

Maybe try opening it up, loosening the rack & pinion, and rotating the pot back just a little, to where the volume is normal?  That is, provided doing so won't bring it back into the bass region, making it a Non-Wah. Depends on where the high freq's are starting to cutoff.

Sounds like maybe a cap problem if that doesn't work; something's not allowing the highs to pass or is bleeding them to ground.  I'd suspect a cap or the inductor.  More symptom information might be able to narrow that down....

ayayay!

Sounds to me like the bias of Q1 is off.  Try lowering the emitter resistor a little.  It's the 390 on a Crybaby.  Try 350 or so.

And yeah, the easiest mods is the one above:  change the position of the pot.

What type of wha?  Not posted in the 1st post.
Crybaby, Vox, optical etc?

its a mister crybaby which is essentially half wah half volume pedal with boost.

adjusting the pot wont really do anything because its set stock and almost all volume drops out in the toe position. it could be the inductor because ive never seen one like this and maybe it sustained some damage before.

the inductor kind of looks like he one on the right: http://www.pisotones.com/Articulos/CrybabyMOD/Fasel/Inductores.jpg

again its a completely stock wah that has probably seen some rough use; i bought it at a garage sale recently

If you have a DMM.  First thing I would do is check the wha pot.  Measure the resistance of the wiper to ground.  As you turn the pot the resistance readings should change.  When you get to the toe down position do you lose contact betwen the wiper and the pots resistive element?  If so it could be a bad pot that has no/bad contact between the wiper and pot at toe down position.

If the wha works at all the inductor is most likely good.

Before you change anything I would figure out what is broken first.

Nah im fairly positive the pot is good. since its half a volume pedal that side works fine.

the volume dropout is exponential as high end should increase, volume tapers off.
