It sounds like the regulator output is the same as the input.  Double-check that the regulator's middle pin is connected to ground.  The mounting tab on a TO-220 is usually gnd too, but it's better to rely on pin 2.

i found out the problem to be the cap before my voltage regulator

I found it...I just had the 78L05 backwards...I checked the data sheet and figured it out....seems to work pretty well now...but I do get some funny sounds and ticking with guitar when I crank up the pots.......
