Tone Bender MK3, slight problem

I just built a MKIII this past weekend and I have a perplexing problem. With the fuzz knob at max I get quite a bit of noise. But if I touch Q3 for a few seconds to warm it up a bit the noise completely goes away even with single coils. It's perplexing because I would expect gain and leakage and thus noise to increase as the temp increases. And isn't the diode supposed to stabilize the effect of temp changes? Otherwise it sounds awesome.  Should I just try a different transistor, or diode? Transistors are CV5416's, gains 54, 57, and 81 with acceptable leakage amounts, and an OA99 diode.   Any ideas?

I found the problem. It was the diode. Apparently the forward voltage of the OA99 is too high (~.6V).   I changed it to a 1N270 (~.3V)  and all is peachy now.
